This seminar will look at key steps in the establishment, life, and the ending of a trust. It will cover what should be considered when advising on the use of trusts including important tax considerations.

In terms of the drafting of trusts, key rules, terms and clauses will be examined including those which have tax and other fiscal consequences, advantages and traps. The nature of assets (and the associated tax issues) will also be addressed. The interaction with personal estate planning and other trusts in existence or future contemplation will also be involved here.

The seminar will help delegates with not only trusts in health but also sickness including variations, problematic trustees, trustee disputes, challenges from beneficiaries and their remedies and trustee litigation risk.

The session will cover specialist types of trust such as personal injury trusts, public non-charitable and charities. The issues attached to trusts set up under wills and deeds of variation as well during lifetime will be part of the discussion. As trusts do not exist in a legal vacuum, the session will also benefit from financial/investment and accountancy contributions to bring the complete trust advice package together.

Mark is an experienced tax advisor, specialising in advising owner managed businesses and entrepreneurs on all aspects of their tax affairs from corporate tax through to income tax, capital gains tax and inheritance tax. He thoroughly enjoys getting to know his clients, and working with them to help them achieve their commercial goals in a tax efficient manner.

He has significant experience in advising on succession planning, employee incentive schemes, M&A, real estate investment and corporate restructuring. Recent transactions include being the lead tax advisor on the Management Buy Out of AMG Group Limited in 2014 which was named "MBO of the Year" at the 2014 Deal and Dealmakers Awards.



Christopher works within a small, vibrant team at the Edinburgh office of Investec. He manages assets on behalf of private individuals throughout the UK, plus trusts and SIPPS. Christopher is also responsible for the management of a number of Charity Accounts.

Alan is a Partner in Brodies LLP, based in Glasgow. His work covers three main areas: charities, private client and parliamentary matters.

Alan's private client work covers estate planning including wills, executries, trusts and inheritance tax. He is the author of the Scotland chapter in the textbook International Succession. As part of his private client advice Alan often advises on incapacity law (powers of attorney, court appointed guardianship and other methods of managing the affairs of those less able to do so). This has involved acting in some of the leading Sottish cases on incapacity law and estate and succession planning. A regular commentator on incapacity law matters, Alan's written work has been referred to in judicial decision making. Of Alan's private client work, the Legal 500 notes that he "conveys complicated legal concepts with clarity and humour".

He was previously a member of the legal staff at the Scottish Law Commission and currently lectures at the University of Strathclyde in property, trusts and charities. Alan has also tutored private client law at the University of Glasgow.

Alan was a member of the Council of the Law Society of Scotland from 2007 to 2009 and the Society's Education and Training Committee from 2007 to 2012. He is currently a member of the Society's Charity Law and Mental Health and Disability Law Committees.
