Restrictive covenant clauses are found in a variety of contracts from employment contracts to franchise agreements. Their purpose is to protect businesses after the termination of contracts. A business may wish to prevent the other party making use of confidential information or a business may wish to prevent an ex-employee from competing with it.
The aim of the seminar is to give practical guidance to attendees on the drafting of restrictive covenants and the enforceability of restrictive covenant clauses.
The course will consider the key issues relating to restrictive covenants in Scottish contracts and is designed for solicitors providing advice on commercial contracts and employment contracts. The course will also be of interest to litigation solicitors who may be instructed to enforce restrictive covenants by way of interim interdicts against business sellers and ex-employees.

Neil Morrison is an Associate at HBJ Gateley focusing his practice on complex commercial litigation and arbitration. He has successfully argued for clients before Sheriffs, Sheriff Principals, and Arbitrators.
