Award-winning employment commentator Stephen Miller of Clyde & Co will host an entertaining lecture in his trademark style, bringing to life topical and important cases from the courts and tribunals centred on the main areas encountered in everyday practice. By reflecting on the lessons in these precedents delegates will:

  • Recognise the importance of the investigatory stage of disciplinary processes, and what standards are expected of employers
  • Learn how employers should deal with conflicts of evidence in misconduct cases
  • Consider the best way to handle personality clashes
  • Understand the difference between contractual terms which can only be varied by agreement, and workplace rules and conditions which can be changed unilaterally
  • Appreciate the thinking behind the normative effect of Collective Agreements, and the static and dynamic schools of interpretation
  • Focus on the European influence on employment law, and what is likely to happen after Brexit
  • Distinguish between direct and indirect discrimination, and review how to mount a successful justification defence
  • Develop a good working understanding of how Public Interest Disclosure (or Whistle-blowing) cases must be advanced, and where the pitfalls lie
  • Learn the secrets of equal pay and job evaluation, and what makes this type of litigation so tricky
  • The session will be fully interactive, and will include a general Q&A section as well as an update on legislative plans and tribunal reform.

    Stephen is accredited as a specialist in employment law and in discrimination law by The Law Society of Scotland. He advises on and represents clients in all areas of employment law from discrimination and disciplinary issues and executive exits to reorganisations, redundancies and equal pay issues. Having represented both private and public sector organisations in a number of high profile tribunals throughout the UK, Stephen is regularly involved in providing strategic advice and training to clients in the local authority, transport, charity and further and higher education sectors.

    Chambers Guide to the Legal Profession, in ranking him in its top band of specialists since 1999, has previously described Stephen as having "a good balance between knowing the law and presenting it in a sound and not over-stated way" as well as being "able and well-prepared" and "a leading player" in relation to his employment law expertise.

    Chambers 2016 has ranked Stephen as Band 1 and has stated that Stephen, "has a very pragmatic approach, a great depth of knowledge and handles negotiations superbly." Also, he has been recognised as a leading individual by the Legal 500 this year.
